Terms and Conditions of the Kotlin Turns 15 Anniversary Campaign
By participating, all participants in the Kotlin Turns 15 Anniversary Campaign (the "Campaign") agree to the following terms and conditions:
- ORGANIZER: JetBrains s.r.o., Na Hrebenech II 1718/8, Prague 4, 14700, Czech Republic (“Organizer”).
- TIMELINE
- The Campaign takes place from July 1, 2026 until October 15, 2026(“Campaign Period”).
- Any submissions received outside of the designated Campaign Period shall be considered null and void. The Organizer assumes no responsibility for participation attempts made before the start date or after the closing of the Campaign Period.
- ELIGIBILITY
- The Campaign is open to individuals who are 18 years of age or older. Participants who are minors in their country of residence may participate only with the prior consent of their parent or legal guardian, where required by applicable law.
- NATURE OF THE CAMPAIGN
- Goal. The objective of the Campaign is to celebrate Kotlin’s 15th anniversary, foster community engagement, and give the Kotlin community an opportunity to share a personalized birthday message as part of the anniversary celebrations.
- Platform(s). The Campaign is hosted on https://kotlinlang.org/kotlin-effect
- How to Participate. To participate in the Campaign, individuals complete the following steps:
- Participants may follow one of two paths:
- Photo. The participant uploads their own photograph. By uploading a photo to generate a stylized postcard, the participant acknowledges that the image will be processed via the Vertex AI API provided by Google LLC. Participants are encouraged to review Google Cloud’s terms and conditions.
- Uploaded photos and generated postcards are stored securely in the Organizer’s infrastructure for a maximum period of one (1) week for the sole purpose of participation and postcard retrieval. After this period, all such files are automatically and permanently deleted.
- The Organizer may process basic technical data (including IP addresses and timestamps) for security, abuse prevention, and service optimization.
- Birthday Wish. The participant may enter a birthday wish or personal note for Kotlin without uploading a photograph.

- Review the generated postcard.
- Participation is voluntary, and the participant may choose not to proceed if they are unsatisfied with the result - generated postcard.
- Share their generated postcard on social media platforms. Sharing is entirely optional.
- No Prize Element. This Campaign does not include any prize draw, giveaway, reward, or award of any kind. Participation is for creative and community engagement purposes only. No purchase or payment is required or relevant to participation.
- INTELLECTUAL PROPERTY
- In case Organizer makes available to participants as a part of the Campaign materials, data, tools or other content - they are the property of Organizer, its affiliates, or partners. Any such content may be protected by copyright, trademark, and other intellectual property laws. Unless the Organizer gives participants written permission, they may not copy, share, modify, download, upload, publish or use any of this content for any purpose other than participation in the Campaign.
- Participants retain full ownership of any materials, content, or work results submitted as part of the Campaign. However, by submitting any such content, participants grant Organizer a free, non-exclusive, worldwide, transferable, perpetual, and irrevocable license to use the submitted content for any lawful purpose. This includes, without limitation, the rights to copy, display, adapt, modify, distribute, publish, translate, and create derivative works from the content, in any medium and through any channels, whether digital, print, or otherwise. The Organizer is under no obligation to use any submitted content. Participants waive any right to withdraw the license on the basis of non-use or limited use by the Organizer.
- Participants acknowledge and agree that:
- They will not receive any compensation or payment for the submitted content;
- They do not expect the content to be or remain confidential;
- Organizer may publicly display or feature submitted content alongside advertisements, promotional materials, or other public communications.
- Participants represent and warrant that:
- They own or obtained all necessary rights to the content submitted. Including any photographs or images submitted;
- The content does not infringe upon the law, rights of any third party, including but not limited to intellectual property, privacy, publicity, or contractual rights;
- All necessary permissions, approvals, and licenses for any third-party materials included in the submission have been obtained. Upon request, Participants must provide the Organizer with a copy of any documentation confirming such permissions, approvals, or licenses.
- Any violation of the above may result in immediate disqualification (i.e. blocking further participation) from the Campaign.
- CONTENT REQUIREMENTS AND ACCEPTABLE USE
- Any content submitted by a participant — including photographs, birthday wishes, and text notes — must be the participant’s original work or content over which the participant holds the necessary rights. Submitted content must not:
- infringe any third-party intellectual property, privacy, personality or publicity rights;
- contain personal data of any other individual without that person’s prior, freely given, and informed consent;
- be unlawful, harmful, defamatory, obscene, hateful, threatening, harassing, or otherwise objectionable;
- contain any material that promotes discrimination, violence, or illegal activity.
- No bots, scripts, automated entries, or macro tools may be used to interact with or exploit the Campaign functionality. No reverse-engineering, scraping, or exploitation of technical vulnerabilities is permitted. The Organizer may disqualify (i.e. remove the submission and block further participation) entries that, in its sole discretion, represent an abuse of the Campaign or violation of these terms and conditions.
- Any user-submitted content and AI-generated output is the sole responsibility of the participant. The Organizer does not endorse, control, or assume responsibility for any content submitted by participants or generated at their direction.
- MISCELLANEOUS
- The Organizer reserves the right to discontinue, cancel, or reschedule the Campaign if necessary or for valid reasons at its sole discretion.
- If the Campaign involves use of third-party platforms, e.g., X, Instagram, GitHub, YouTube, etc.(“Platforms”), Participants must have an account in good standing and comply with the terms and conditions of Platforms. This Campaign is in no way sponsored, endorsed, or administered by, or associated with, any Platforms.
- The Organizer is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilized in this Campaign, or for any technical error that may occur during the administration of this Campaign. Organizer assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, or theft, destruction, or unauthorized access to, or alteration of, any submissions.
- PARTICIPANTS ENTER THE CAMPAIGN AT THEIR OWN RISK. ANY DELIVERABLES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, (I) ORGANIZER HEREBY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE CAMPAIGN AND (II) ORGANIZER SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO PARTICIPATION OR INABILITY TO PARTICIPATE IN THE CAMPAIGN. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BY PARTICIPATING, PARTICIPANTS AGREE TO RELEASE AND HOLD HARMLESS THE ORGANIZER FROM ANY AND ALL LIABILITY FOR LOSSES OR DAMAGES OF ANY KIND ARISING FROM OR IN CONNECTION WITH PARTICIPATION.
- The Organizer assumes no responsibility for any computer, online, or telephone transmission or technical malfunctions that may occur during participation in the Campaign. Organizer is not responsible for any incorrect or inaccurate information, whether arising from website users, Campaign participants, or any of the equipment or programming associated with or utilized in the Campaign, or for any technical or human error which may occur in the processing of Campaign submissions. The Organizer assumes no responsibility for any error, interruption, defect, or delay in operation or transmission, failures or technical malfunction of the internet, or any telephone networks or lines, computer online systems, servers, computer hardware, software, or email service providers. The Organizer is not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Campaign (if applicable). Some jurisdictions may not allow certain limitations on liability and so the foregoing limitations may not apply to every participant.
- To the extent permitted by the law, Organizer will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property because of any person entering the Campaign or using any generated postcards.
- The Campaign and these terms and conditions are governed by the laws of the Czech Republic; by entering the Campaign all participants agree to personal jurisdiction and venue therein
- These terms and conditions constitute the final, complete, and exclusive understanding between the Organizer and any participant with respect to the participant’s participation in the Campaign, and supersede any prior or contemporaneous representations, rules, or agreements, whether written or oral.
- In the event of any disputes regarding the Campaign, including eligibility OR ANY conduct, the decision of the Organizer shall be final and binding and the Organizer reserves the right to interpret these terms and conditions at its sole discretion.
- This Campaign does not constitute a lottery or gambling activity within the meaning of applicable law and it is void where prohibited.
- PRIVACY NOTICE
- Participation in the Campaign requires processing of personal data and the following data will be processed for each participant: first name, last name, email address, shared postcard URL, personal image.

- Where participants upload a photograph as part of their postcard, the Organizer engages Google LLC (Google Cloud / Vertex AI) as a sub-processor to perform AI-based image processing on its behalf.
